Estate Planning — Kyun Zaroori Hai?

Pakistan mein estimated 70% log bina will (wasiyat) ke marte hain. Is ka natija: family mein 5-10 saal tak court battles, property disputes, daughters ke rights deny, aur kabhi kabhi criminal cases. Estate planning yeh sab prevent karti hai. Thoda paisa aur time aaj invest kar ke aap apni family ko immense stress aur financial loss se bacha sakte hain.

Estate planning sirf ameer logon ke liye nahi — har insaan ko jis ke paas bhi property, bank accounts, investments, ya family dependencies hain, unhe estate plan banana chahiye. Rs 5 lakh ki savings ho ya Rs 50 crore ki, document kar ke family ko informed karna essential hai.

Estate Planning Ke 6 Main Components

  1. Wasiyat (Will): Aap ki death ke baad assets distribute karne ka document.
  2. Hiba (Gift): Lifetime mein property transfer.
  3. Trust (Waqf): Charitable ya family trust.
  4. Power of Attorney (POA): Kisi ko aap ki behalf par decisions karne ka authority.
  5. Letter of Administration: Court se milta hai agar koi will nahi hai.
  6. Succession Certificate: Bank accounts, shares ke liye agar will nahi.

Hiba (Gift) — Lifetime Transfer

Hiba zinda dili mein property transfer ka Islamic concept hai. Yeh inheritance mein nahi count hota — already transfer ho chuka hota hai.

Parents aksar hiba ke through daughters ko bhi equal share dete hain — Quranic inheritance (2:1) ke bawajood. Yeh legally valid hai aur family disputes prevent karta hai.

Trust (Waqf) — Family Trust Structure

Trust ek legal entity hai jo property manage karti hai beneficiaries ke liye. Pakistan mein family trusts popular ho rahi hain — wealthy families ke liye.

Power of Attorney (POA)

POA ek legal document hai jis mein aap kisi ko apni behalf par decisions lene ka authority dete hain. Types:

1. General Power of Attorney

Broad powers — bank, property, business, sab kuch. Risk: Misuse ho sakta hai. Overseas Pakistanis ke liye useful.

2. Special Power of Attorney

Specific purpose — sirf ek kaam ke liye. E.g., property sale ke liye, bank account operate karne ke liye. Safer than general.

3. Durable Power of Attorney

Aap incapacitate ho jaayen (coma, mental illness) tab bhi valid. Medical + financial decisions.

4. Springing Power of Attorney

Sirf specific condition par activates (e.g., doctor certify kare ke aap incapacitate ho).
