Gulf EOSB Gratuity Complete Guide — Roman Urdu Mein

Gulf EOSB Kya Hai?

EOSB (End of Service Benefit) ya gratuity woh amount hai jo Gulf countries mein employer ko apne employee ko deni hoti hai jab contract khatam hota hai — chahe resignation ho, retirement ho, ya termination. Yeh western countries ke "pension" ya "severance pay" jaisa concept hai, lekin Gulf mein yeh lump-sum hota hai aur zyada tar monthly pension ke bbadle diya jaata hai.

EOSB Kyun Zaroori Hai Samajhna?

Pakistani aur Indian workers ke liye yeh retirement ka sab se bada asset ban sakta hai. UAE — Federal Decree-Law No. 33 of 2021

UAE ne 2022 mein naya labour law Federal Decree-Law No. 33 of 2021 introduce kiya jo 2 February 2022 se effective hua. Yeh Private Sector employees par apply hota hai aur Old Law No. 8 of 1980 ko replace karta hai.

UAE Gratuity Formula

Example: Agar basic salary AED 5,000 hai aur aap 7 saal kaam karte hain, to gratuity = (5 × 21 × 5000 ÷ 261) + (2 × 30 × 5000 ÷ 261) = 20,114 + 11,494 = AED 31,608. Daily wage calculate karne ke liye monthly basic ko 261 (working days per year) se divide kiya jaata hai.

Resignation vs Termination — UAE

Old law (1980) mein resignation se pehle 5 saal mein kam gratuity milti thi. Naye 2022 law mein yeh restriction hata di gayi hai — ab resignation ya termination dono mein full gratuity milni chahiye agar aap ne 1 saal complete kiya hai. Lekin agar employee "limited contract" chhod ke jaata hai pehle, to employer damages claim kar sakta hai. Unlimited contract mein aisa nahi.

Saudi Arabia — Labour Law Articles 84-87

Saudi Labour Law ki Articles 84-87 gratuity ko regulate karti hain. Saudi law mein yeh "End of Service Award" (مكافأة نهاية الخدمة) kehlati hai.

Saudi Gratuity Formula

Example: SAR 6,000 basic salary, 8 saal kaam = (5 × 0.5 × 6000) + (3 × 1 × 6000) = 15,000 + 18,000 = SAR 33,000.

Saudi Resignation Rules

Agar employee resign karta hai:

Agar employer terminate karta hai ya contract expire hota hai, to full gratuity milti hai chahe service kitni bhi ho (minimum 2 saal). Article 80 ke under misconduct ki wajah se termination par bhi gratuity nahi milti.

Qatar — Law No. 14 of 2004

Qatar Labour Law No. 14 of 2004 (Article 54 aur 55) gratuity ko regulate karta hai.

Example: QAR 7,000 basic salary, 6 saal kaam = (5 × 3 × 7000 ÷ 4.33) + (1 × 4 × 7000 ÷ 4.33) = 24,250 + 6,466 = QAR 30,716. (Note: weekly wage = monthly ÷ 4.33).

Oman — Royal Decree 53/2023

Oman ne 2023 mein naya Labour Law Royal Decree 53/2023 issue kiya jo 26 July 2023 se effective hua. Old Law 35/2003 ko replace karta hai.

Oman mein bhi resignation se pehle 5 saal tak fraction milta hai. 5 saal ke baad full milna shuru ho jaata hai.

Kuwait — Law No. 6 of 2010

Kuwait Private Sector Labour Law No. 6 of 2010 (Article 51) ke mutabiq:

Kuwait mein resign karne par bhi fractions lagte hain (3 saal se kam: nothing, 3-5 saal: 1/2, 5-10 saal: 2/3, 10+: full). Termination par full.

Bahrain — SIO System

Bahrain ka system thora alag hai. Wahan 2007 se Social Insurance Organisation (SIO) ke under "insurance against old age, disability and death" chal raha hai. Employer 3% aur employee 1% contribution karte hain monthly basic salary par. End of service par yeh lump-sum diya jaata hai.

Older employees (jo 2007 se pehle join kiye) ke liye Old Indemnity Law (Articles 65-67 of Law 36/2012) apply hota hai: 1-3 years 1/3, 3-5 years 2/3, 5+ years full gratuity (15 days first 5 years, 1 month after).

Tax Implications — NRI, US Citizens, UK Residents

Pakistan (NRI status)

Pakistan ke FBR ke mutabiq, agar aap Non-Resident Pakistani (NRP) hain aur Gulf mein services perform kar rahe hain, to aap ki Gulf gratuity Pakistan mein tax-free hai. Income Tax Ordinance 2001 ki Section 111 aur foreign income exemption rules ke under, foreign source income (jab services foreign mein perform hui hoon) Pakistan mein taxable nahi.

Lekin agar aap Resident Pakistani hain (Pakistan mein 183+ days in tax year) aur Gulf se gratuity laate hain, to yeh foreign remittance ke under normal case mein exempt hai — lekin State Bank of Pakistan ke remittance channel se aana zaroori hai.

India (NRI status)

Indian Income Tax Act ke under, NRI ke liye foreign source income tax-free hai India mein. Lekin Resident Indian ke liye global income taxable hai. Gulf gratuity India mein tax-free hai agar services Gulf mein perform hui hoon — chahe NRI ho ya Resident (Section 5 aur DTAA ke under).

US Citizens

US citizens aur Green Card holders ke liye global income taxable hai US mein. Foreign Earned Income Exclusion (FEIE) 2024 mein $126,500 hai per person. Gratuity ko "earned income" mana jaata hai agar services foreign mein perform hui hoon — to FEIE use ho sakta hai. Foreign Tax Credit bhi available hai agar kisi country mein tax pay kiya hai.

UK Residents

UK residents ke liye overseas gratuity UK mein taxable hai agar aap Resident OR Ordinarily Resident ho. Non-Resident status (less than 16 days in UK, ya 46 days for 3+ year residents) ke under exemption mil sakta hai. Gulf mein tax nahi lagta, to UK mein 100% taxable ho sakta hai.

Payment Deadlines

Har Gulf country mein gratuity payment ki deadline law mein defined hai:

Deadline miss karne par employer par penalty lag sakti hai aur labour court mein case ho sakta hai.

Dispute Resolution

Agar employer gratuity deny karta hai ya kam pay karta hai:

  1. Pehle HR ke saath formal written complaint file karein (email ke through taake proof rahe).
  2. 15 days mein resolve na ho to Ministry of Labour (UAE MOL app, Saudi Mudad, Qatar Hukoomi, Oman Ministry, Kuwait Shoon, Bahrain SIO) mein online complaint file karein.
  3. Phir bhi resolve na ho to Labour Court mein case ho jaata hai.
  4. Pakistan ke embassy/consulate se bhi madad li ja sakti hai — woh employer ko notice bhej sakte hain.

90% disputes ministry level par solve ho jaate hain — court tak pohanchna rare hai.
