Saudi Arabia mein basic + fixed allowances = actual wage
Gulf countries (UAE, Saudi Arabia, Qatar, Oman, Kuwait, Bahrain) mein jab kisi employee ki service khatam hoti hai — chahe resignation ho, termination ho, ya contract complete ho — to employer ko usay ek lump-sum amount dena hota hai jise End of Service Benefits (EOSB) ya gratuity kehte hain. Yeh amount employee ki years of service aur last drawn salary ke mutabiq calculate hota hai, lekin har country ka formula thoda alag hota hai.

UAE ka Federal Decree-Law No. 33 of 2021 (effective 2 February 2022) ke mutabiq, limited aur unlimited contracts ka farq khatam kar diya gaya hai. Ab sab contracts fixed-term hain aur gratuity formula same hai:

Bahrain ne March 2024 se contribution-based system adopt kiya hai. Social Insurance Organization (SIO) mein employer monthly contribution karta hai: pehle 3 saal ke liye 4.2% basic salary, 3 saal ke baad 8.4%. Employee SIO se direct claim karta hai. Is liye Bahrain ke liye traditional gratuity calculator nahi, balke contribution calculator banaya jata hai.
Real numbers ke saath calculation samjhein
Sab se important concept jo Gulf employees confuse karte hain woh yeh hai ke gratuity kis salary par calculate hoti hai. UAE, Qatar, Oman, aur Kuwait mein gratuity basic salary only par calculate hoti hai — housing allowance, transport allowance, food allowance, ya performance bonus shamil nahi hote. Lekin Saudi Arabia mein "actual wage" use hota hai jis mein basic + tamam fixed regular allowances shamil hote hain (Article 84). Is ka matlab Saudi Arabia mein aap ko zyada gratuity milegi same salary ke, kyunke base zyada hai.
Yeh baat negotiation time par yaad rakhein — agar employer basic salary kam rakhe aur allowances zyada, to UAE/Qatar/Oman/Kuwait mein aap ki gratuity kam hogi. Lekin Saudi Arabia mein farq nahi parta. Practical example: AED 15,000 monthly package hai, basic sirf AED 7,000 aur allowances AED 8,000. UAE mein gratuity AED 7,000 par calculate hogi. Lekin agar same structure Saudi Arabia mein ho, to actual wage AED 15,000 par calculate hogi.
UAE ke free zones ke apne employment regulations hain jo broadly UAE Labour Law ko follow karte hain gratuity calculation mein, lekin kuch procedural differences hain:
Gulf countries khud koi personal income tax nahi lagate, lekin aap ke home country mein tax lag sakta hai. Yeh critical hai overseas employees ke liye jo home country mein tax-resident hain:
Non-resident Pakistani (saal mein 183 din se kam Pakistan mein) hain to Gulf ki gratuity Pakistan mein tax-free hai. Lekin agar aap Pakistan wapas aate hain aur tax-resident ban jaate hain, to us saal ki gratuity Pakistan mein taxable ho sakti hai. DTAA agreements Pakistan ke GCC countries ke saath hain.
NRIs ke liye Gulf ki gratuity generally India mein tax-free hai under Section 10(10)(ii) — 5+ saal continuous service ho to. Maximum exemption Rs 20 lakh hai private sector employees ke liye.
USA worldwide taxation karta hai. Gulf ki gratuity par Foreign Earned Income Exclusion (FEIE) apply ho sakta hai (2024 mein $130,000 tak exemption agar Foreign Tax Resident ho).

Saudi mein Qiwa platform ke through complaint, phir Labour Courts. Qatar mein Ministry of Labour (ADLSA) online complaint, phir Labour Court. Process 3-6 months typically leta hai. Free zones ke apne courts hain (DIFC courts, ADGM courts) jo English mein operate karte hain.
